Terms of service

  1. General
  • The following contractual provisions (GTC) apply to all contracts concluded with the customer (hereinafter: CUSTOMER) via the online shop of Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany (hereinafter: SELLER) under the domain www.morenutrition.nl .

  • The presentation of the products in the SELLER's online shop merely represents a non-binding invitation to the CUSTOMER to place an order. By placing an order, the CUSTOMER makes a binding offer to conclude a contract for the items in the shopping cart. The SELLER will immediately confirm receipt of the order by email. The automated order confirmation from the shop system does not constitute a contractual relationship. A contract is only concluded when the SELLER accepts the CUSTOMER's offer by delivering the ordered items to the CUSTOMER. Only with this separate declaration of acceptance does the purchase contract with Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany come into effect.

  • Only private individuals are considered CUSTOMERS.

    The SELLER reserves the right to update these conditions as necessary. Changes will be communicated to the CUSTOMERS in a timely manner and will only be effective with the consent of the CUSTOMERS.

     

    1. ordering process
    • The CUSTOMER can place the desired items in the shopping cart by clicking on the corresponding button and start the order process by clicking on the shopping cart. During the order process, the CUSTOMER must enter the necessary contact details for shipping and payment. It is also possible to create a customer account and save the entered order data for future orders. The order is completed by clicking on the "Buy" button. If the CUSTOMER decides to pay via PayPal, the order is completed after being redirected to the PayPal page by clicking on the "Complete purchase" button.

    • Orders exceeding quantities customary for private consumption may be rejected or cancelled. The CUSTOMER will be notified of this.

    • The CUSTOMER can correct input errors, especially items placed in the shopping cart by mistake, by entering the desired quantity in the shopping cart and using the buttons provided. During the ordering process, the CUSTOMER can correct input errors in the various steps by navigating to the respective step using the browser's "forward" and "back" buttons.

    • By completing the order, the CUSTOMER declares that he has read the General Terms and Conditions, the data protection provisions and the cancellation policy.

    • The contract language is German.

     

    • The minimum purchase value for gift promotions refers to the lowest value that must be reached after deducting possible returns. If the minimum purchase value is not reached due to a complete or partial cancellation of the order, the gift must be returned to us.

      1. right of withdrawal

      If the CUSTOMER is a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to his or her commercial or independent professional activity), the CUSTOMER has a right of withdrawal in accordance with the statutory provisions.

      You have the right to withdraw from this contract within fourteen days without giving any reason.

      The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

      To exercise your right of withdrawal, you must inform us (Quality First GmbH Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany, email: info@morenutrition.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You can use the attached model withdrawal form for this purpose, but this is not mandatory. You can also electronically fill out and submit the model withdrawal form or another clear statement on our website. If you make use of this option, we will immediately send you a confirmation of receipt of such a withdrawal (e.g. by email).

      To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

       

      consequences of revocation

      If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choosing a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

      You must return or hand over the goods promptly and in any event no later than fourteen days from the date on which you notify us that you have cancelled this contract (see note: Return of products). This deadline is met if you send the goods before the expiry of the fourteen-day period. You will bear the direct cost of returning the goods. You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

      1. Exclusion or premature expiry of the right of withdrawal
      The right of withdrawal does not apply to distance contracts:
      • for the delivery of goods which are liable to spoil quickly or whose expiry date would quickly be exceeded;
      • for the supply of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery;
      • for the delivery of goods if, after delivery, they have been inseparably mixed with other goods due to their nature.

        7. Note: Return of products

        The goods should be returned to Quality First GmbH, c/o MBS Sports GmbH, Bukarester Str. 11, 93055 Regensburg in the original packaging with all accessories and packaging components if possible. The SELLER asks that protective packaging be used to ensure adequate protection against any transport damage if the original packaging is no longer available. Damage and contamination to the returned item should be avoided. CUSTOMERS are asked to send the physical products back to the seller as a prepaid package and to keep the delivery receipt. The costs for returning the goods are to be borne by the CUSTOMER. THE SELLER points out that the right of withdrawal and its consequences naturally exist regardless of compliance with this notice; it merely serves to facilitate the processing of returns.         8. Prices and shipping costs
        • The prices valid on the day of the order as displayed in the online shop apply.

        • The prices displayed in the online shop are in euros and include VAT.

        • When purchasing goods that are delivered in a package or otherwise by post, the following applies: The prices displayed in the online shop do not include shipping costs for packaging and postage. The shipping costs are calculated dynamically during the ordering process and displayed in the shopping cart overview before ordering.


          9. Terms of payment
            The SELLER only accepts the payment methods offered during the ordering process in the online store. These are:

            1. Paypal
            2. Credit card: Visa, Mastercard, American Express
            3. IMMEDIATELY
            4. eps transfer
            5. Apple Pay
            6. Google Pay

              • The CUSTOMER selects his preferred payment method from the available payment methods.

              • Paypal: If payment is made via PayPal, the CUSTOMER must have a PayPal account and identify themselves with their PayPal access data. The CUSTOMER must then go through the PayPal payment process and confirm the payment to the SELLER. Payments can also be made using the PayPal payment method without a PayPal user account. With regard to PayPal's guest function, the terms and conditions available via the payment method apply. If the CUSTOMER chooses to pay by credit card in PayPal, he may be asked for a required second authentication feature by displaying the credit institution's website, depending on the amount of the payment or the type of delivery. The CUSTOMER must then verify the payment process with his personal second authentication feature such as password, PIN, TAN or biometric data such as fingerprint or facial scan using a special app.

              • Credit card: If a delivery is made against payment by credit card, the CUSTOMER authorizes the full invoice amount, including delivery and shipping costs, to be charged to the relevant credit card company when due by providing his credit card details. At the end of the ordering process, the CUSTOMER is asked to enter his credit card number, the expiration date of the credit card and the verification code in the corresponding form. Depending on the amount to be paid or the type of delivery, the customer may be asked for a required second authentication feature by displaying the credit institution's website. The CUSTOMER must then verify the payment process with his personal second authentication feature such as password, PIN, TAN or biometric data such as fingerprint or face scan using a special app. The specific type of identification used depends on the respective payment service provider (e.g. the CUSTOMER's credit card company). In this case, the charge is initiated with the order confirmation.

              • If a delivery is made against payment via eps transfer, the CUSTOMER needs an online banking account with one of the participating banks. At the end of the ordering process, the CUSTOMER selects the bank and logs into the private online banking area. There the CUSTOMER checks the payment details already entered. If these are correct, the CUSTOMER authorizes the payment via eps and thus completes the purchase.

              • If a delivery is made against payment via SOFORT, the CUSTOMER logs into his online banking and authorizes the payment via a transaction authentication number (TAN) before the CUSTOMER returns to the webshop.

              • If a delivery is made against payment via Apple Pay, the CUSTOMER pays directly via their own Apple account. After submitting the order, the CUSTOMER is redirected to Apple, where payment of the order amount can be authorized. As soon as the SELLER has been informed of the authorization, the shipment will take place - depending on the delivery time specified for the item. Depending on the payment method stored with Apple Pay, this will be charged immediately after authorization or after shipment with the actual invoice amount after deduction of any discounts, gift vouchers, etc.

              • If a delivery is made against payment via Google Pay, the CUSTOMER pays directly via their own Google account. After submitting the order, the CUSTOMER is redirected to Google, where payment of the order amount can be authorized. As soon as the SELLER has been informed of the authorization, the shipment will take place - depending on the delivery time specified for the item. Depending on the payment method stored with Apple Pay, this will be charged immediately after authorization or after shipment with the actual invoice amount after deduction of any discounts, gift vouchers, etc.

              10. Promotional vouchers and their redemption
              • Promotional vouchers are vouchers that cannot be purchased, but are vouchers that the SELLER issues as part of advertising campaigns with a specific period of validity.

              • Promotional vouchers can only be redeemed during the specified period and only once during an order process. Individual brands may be excluded from the voucher promotion. Promotional vouchers cannot be used to purchase gift vouchers. Please note that promotional vouchers may be tied to a minimum order value.

              • The value of the goods must be at least equal to the amount of the promotional voucher. Any difference to a higher value of goods can be settled using the payment options offered. The value of a promotional voucher will not be paid out in cash and will not accrue interest. The promotional voucher will not be refunded if goods are returned in whole or in part.

              • Promotional vouchers can only be redeemed before the order process is completed. They cannot be credited retroactively. The promotional voucher cannot be transferred to third parties. Multiple promotional vouchers cannot be combined with one another, unless otherwise specified in the terms and conditions of the promotion.

              • Should the total value of the order fall below the respective minimum order value of the promotional voucher used due to a later return of ordered goods, the SELLER reserves the right to calculate the original price of the ordered goods and subsequently invoice the CUSTOMER.

                11. Gift vouchers and their redemption
                • Gift vouchers are vouchers that the CUSTOMER can purchase. These can only be redeemed for the purchase of MORE Nutrition items, but not for the purchase of additional gift vouchers. If the balance of a gift voucher is not sufficient for the order, the difference can be made up using the payment options offered.

                • Gift vouchers and credit can only be redeemed before the order process is completed. The credit on a gift voucher will not be paid out in cash and will not accrue interest.

                  12. Value vouchers , product vouchers and their redemption
                  • Vouchers are vouchers for a specific purchase value that are issued exclusively by the SELLER to the CUSTOMER, e.g. as a gesture of goodwill. They are customer-specific, non-transferable and cannot be purchased. Cash payments are not possible. To redeem a voucher, enter its code in the field provided before completing the order process. The amount deposited for the voucher is deducted from the value of the order. Remaining voucher amounts are retained and can be redeemed the next time the order is placed by re-entering the voucher code as before. Orders whose value exceeds the voucher amount can be paid for using the payment options offered.

                  • Product vouchers are vouchers for a specific product (e.g. for a chunky flavour) that are issued exclusively by the SELLER to the CUSTOMER, e.g. as a gesture of goodwill. They are customer-specific, non-transferable and cannot be purchased. Cash payments are not possible. To redeem a product voucher, the code is entered in the field provided in the customer account support centre. The product for which the product voucher is stored is automatically stored in the customer's shopping cart and added to the order.

                    13. Delivery and shipping conditions – Information on calculating the delivery date
                    • The delivery of the goods, which are delivered in a package or in any other way by post, will be made, unless otherwise agreed with the CUSTOMER, by post (package, parcel, letter, forwarding agent, etc.) to the delivery address provided by the CUSTOMER in the order.

                    • The delivery time is stated separately for each article or in the product description on the article page.

                    • For all other payment methods, the delivery time stated on the item page begins on the working day after the day on which the contract is concluded.

                    • Orders can be placed by all CUSTOMERS from the European Economic Area and, if applicable, other countries specified in the online shop and/or in the shipping costs table. Orders are only delivered to Germany and to the countries specified in the online shop and/or in the shipping costs table.

                    • If the carrier returns the purchased item to the SELLER because delivery to the CUSTOMER was not possible, the CUSTOMER will bear the costs of re-shipping. This does not apply if the CUSTOMER has exercised any existing right of withdrawal at the same time as refusing to accept the item, or if he is not responsible for the circumstances that led to the impossibility of delivery, or if the CUSTOMER was temporarily prevented from accepting the service offered, unless the SELLER had announced the service to him a reasonable time in advance.

                      14. Repayments

                      The SELLER will automatically arrange for any refunds to be made to the account used by the CUSTOMER for payment. If the CUSTOMER has paid via PayPal or credit card, the refund will be made to the associated PayPal or credit card account. If the CUSTOMER has used a gift voucher to make the purchase, the corresponding amount will be credited to his gift voucher account.

                       

                      15. Retention of title

                      The SELLER reserves ownership of the items sold until the purchase price has been paid in full.

                       

                      16. Warranty/Liability for Defects

                      The rights in the event of defects in the purchased item are governed by the statutory provisions.
                      17. Customer Account
                      • The CUSTOMER can create a customer account in the online shop free of charge.
                      • When creating a customer account, the CUSTOMER is asked to provide his personal data in accordance with the SELLER's privacy policy. By providing his data, the CUSTOMER guarantees that it is authentic and correct. He is also obliged to keep the data up to date in the event of an order. Additional shipping costs incurred by the SELLER due to incorrect or incorrectly entered data will be invoiced to the CUSTOMER. After the creation of the customer account has been requested by clicking on "Create", the CUSTOMER receives an email.

                      • By clicking on the link contained therein, the CUSTOMER confirms his identity and receives confirmation of the creation of his customer account by email.

                      • The CUSTOMER is entitled to register and operate only one customer account on morenutrition.de at a time. If the SELLER becomes aware of multiple registrations, the SELLER is entitled to exclude the CUSTOMER from using the web shop. CUSTOMERS whose customer account has already been blocked or terminated by us in the past are not permitted to create a new customer account. Minors are not permitted to register.
                      • CUSTOMER and SELLER can terminate the contract for the customer account at any time with immediate effect for the future without giving reasons. The SELLER reserves the right to delete the registration of CUSTOMERS who have not provided complete or incorrect data.
                      18. Data storage and data protection

                      Only the data protection provisions of the data protection declaration at https://morenutrition.de/pages/datenschutzerklarung apply.

                      19. Alternative dispute resolution

                      The SELLER is not obliged and not willing to participate in dispute settlement proceedings before a consumer arbitration board

                      20. Final Provisions
                      • The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
                      • The above choice of law shall only apply to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the CUSTOMER has his habitual residence.
